Hong Kong Trademark Registration

Registered trademark can enhance reputation and is valued by all industries. Trademark registration ensures exclusive rights and protection over the trademark that is registered and can give rise to legal action and claim for compensation on any infringement on those rights.

Procedure
1. Pre-filing Trademark Search:
‧ The trademark registration is basically run on a “first-in, first serve” basis
‧ Sample is required to prepare for a registration search with the Trade Marks Registry
‧ The Trade Marks Registry shall return with a tentative opinion or suggested modifications on the samples
‧ Application starts upon the confirmation of the trademark sample
2. Application:
‧ The Trade Marks Registry will complete the assessment based on the criteria laid down in the“Trade Marks Ordinance”
3. Posting on the gazette:
‧ The approved trademark will be published on the “Hong Kong Intellectual Property Journal”
‧ Final Assessment will be processed if no objection is received within the 3-month period from the publication date
‧ A Registration Certificate will be issued by the Trade Marks Registry
Remarks ‧ The first installment of this service shall be paid before the commencement of the registration search without refund under any circumstances
‧ The first installment includes 2 free registration searches in which an additional charge would be applied to the 3rd registration search thereafter
‧ The trademark registration fee would cover only 1 type of trademark classification
‧ An additional government registration fee should be paid for each additional class of trademark registration
Continuance Service ‧ Trademark registration is valid for 10 years since 1st April 2003 with a possible renewal of 10 years registration upon its expiration
‧ Renewal of registration shall be made before expiration in order to avoid “Late Renewal
Surcharge”
‧ A restoration and renewal fee shall be paid if a trademark has expired more than 6 months, or a new application of trademark registration is required

UK & EU Trademark Registration

With the UK trademark and EU trademark, the reputation of the brand can be enhanced in the UK and EU market. The owner / business of the registered EU trademark can make use of the exclusive rights of the registered EU trademark in 28 different countries among the EU.

 

Procedure
1. Comprehensive Pre-registration Search:

‧The Trade Marks Registry shall return with a tentative opinion or suggested modifications on the samples
‧ Application starts upon the confirmation of the trademark pattern
2. Submit Application:
‧ The Trade Marks Registry will complete the assessment based on the criteria set in
the“Trade Marks Ordinance”
3. Scope of application:
‧ UK Trademark: United Kingdom
‧ EU Trademarks: 28 countries, as follows:
Austria, Bulgaria, Belgium, Croatia, the Czech Republic, Cyprus, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Romania, Slovakia, Slovenia, Spain, Sweden and the United Kingdom
Remarks ‧ Provided with one free comprehensive search in which an additional charge would be applied to the 2nd comprehensive search thereafter
‧ The trademark registration fee would cover only 1 type of trademark classification
‧ An additional government registration fee should be paid for each additional class of trademark registration
Continuance Service ‧ Trademark registration is valid for 10 years with a possible renewal of 10 years registration upon its expiration
‧ Renewal of registration shall be applied before expiration in order to avoid “Late Renewal Surcharge”
‧A restoration and renewal fee shall be paid if a trademark has expired for more than 6 months, or a new application of trademark registration is required

Singapore Trademark Registration

Trademark is a legal right for an individual or body corporate to own and use exclusively of a certain design, brand or logo in certain countries. Procedure
The total length of trademark registration and process is approximately 6 months.
Procedures are as follows:
1. Complete the Application form for trademark
2. Trademark comprehensive search
3. Application submission - minimum requirement (Preliminary approval)
4. Examination period by Intellectual Property Office of Singapore (IPOS) approximately 4 months
5. IPOS publishes trademark approximately 2 months
6. IPOS issuance of official registration certificate
Note: Any opposition during publication period or re-issue of examination report will require additional time by the IPOS

Continuance Service ‧ Trademark registration is valid for 10 years and able for renewal of 10 years registration upon renewal date
‧ Renewal registration shall be applied before the expiration date in order to avoid any “Late Renewal Penalties and
Surcharge”
‧A restoration and renewal fee shall be paid if a trademark has been expired for 6-12 month after the due date of the renewal or otherwise require new registration
